Link’s Legal Strategy Group works with Greener UK and other partners, to ensure the environmental and animal welfare protections that were afforded by EU legislation are matched or improved now that the UK has left the EU. This includes close working with Greener UK on the Environment Bill, which is intended to provide a new framework of post Brexit environmental regulations. The Legal Strategy Group also works with our sister Links to advocate for fit for purpose application of the UK’s obligations under the Aarhus Convention. The Convention establishes several important rights of the public (individuals and their associations) with regard to the environment, including the right to access justice and challenge public decisions on environmental law.
In October 2020, the Group submitted evidence to the panel, led by Lord Faulkes, reviewing Judicial Review. In April 2021 the Group submitted a full response to the Government's subsequent proposals for changes to Judicial Review, which helped persuade the Government to drop some of its more damaging proposals. The Group is now working to improve the Judicial Review and Courts Bill, introduced in July 2021.
